EU Digital Services Act

The Digital Services Act (“DSA”), officially Regulation (EU) 2022/2065, is a European Union (“EU”) Regulation that came into force on November 16, 2022. Siemens (Siemens AG and/or its subsidiaries) adheres to the DSA to prevent illegal activities on online platforms and better protect the fundamental rights of users. Siemens is committed to promoting transparency and data security for all users of its platforms and recognizes the importance of regulating online platforms and services. Siemens supports the European Commission’s objectives of creating a safer online environment by holding digital platforms accountable for illegal content and harmful activities.

Information on ‘average monthly recipients’ of Siemens

Under Article 24(2) of the DSA, online platforms are required to publish ‘information on the average monthly active recipients of the service’ in the EU by 17 February 2023 and at least once every six months thereafter. This is for the purposes of determining whether an online platform is a “very large online platform” (“VLOP”), defined as those reaching at least 45 million monthly users in the EU (10% of the EU population). VLOPs are subject to additional requirements due to the role they play in the dissemination of content throughout the EU.

We regularly monitor the number of users, with evaluations conducted at least every six months. Based on the last evaluation in the preceding 6 months period, the average number of monthly active recipients of Siemens online platforms in the EU was well below the threshold of 45 million. We will continue to monitor the number of average monthly active recipients on Siemens online platforms in the EU and will publish updated information in accordance with Article 24(2) of the DSA.

Single point of contact for authorities, trusted flagge

Article 11 of the DSA requires online platforms to designate a single point of contact to enable direct communication with the European Commission, EU Member States’ authorities, and the European Board for Digital Services regarding the application of the DSA. These authorities may contact Siemens regarding the DSA at dsa@siemens.com.

Entities carrying the ‘trusted flagger’ status as per Article 22 of the DSA may send their notices under Article 16 of the DSA to dsa@siemens.com.

Reporting illegal content

If there is content on Siemens online platforms considered illegal, reports can be made by emailing dsa@siemens.com.

Disputes about user content and accounts

The DSA provides opportunities to dispute the decisions that online platforms make about content and user accounts. If you believe that we have mistakenly taken action against your account or reported content, you can appeal our decision within six months by sending an email to dsa@siemens.com. Please include a reason for your appeal and attach any supporting documents (if available).

You may also contact a certified out-of-court dispute settlement body to help resolve any dispute with us relating to our actions on your account or reported content, including if you disagree with the outcome of an appeal. The European Commission will publish a list of available dispute settlement bodies as they become certified. Decisions by out-of-court dispute settlement bodies are not binding on you or on Siemens.
