All content and information published on this site by Siemens or its affiliated companies are protected by the following terms of use. All users browsing or benefiting from the site will be deemed to have accepted these terms of use.
1. Scope
Any use of this website ("Siemens Website") provided by Siemens Aktiengesellschaft and/or its affiliates ("Siemens") is subject to these Terms of Use. These Terms of Use may be amended, modified, or renewed under various conditions and circumstances, such as the purchase of products and services. When logging in to access or use the Siemens Website, or when entering without requiring a login, these Terms of Use are deemed to have been accepted in their currently valid version.
If offers are made to businesses or public institutions via the Web, these businesses or institutions are represented by the user, and it is assumed that the user has sufficient knowledge and will act accordingly.
2. Services
This Siemens Website contains certain information, software, and (where applicable) documents for viewing and downloading purposes.
Siemens may discontinue the operation of the Siemens Website entirely or partially at any time. Siemens does not assume any responsibility for the continuous availability of the Siemens Website due to the nature of the internet and computer systems.
3. Registration and Password
Some pages of the Siemens Website may be password-protected. For the security of business transactions, only registered Users can access these pages. Siemens reserves the right not to grant registration permission to any User.
Siemens specifically reserves the right to make some sites, which were previously freely accessible to everyone, subject to registration. Siemens specifically has the right to prohibit a user's access to password-protected areas at any time and without the obligation to state any reason, especially if the following situations occur. If the User:
- uses incorrect information for registration;
- violates these Terms of Use or their legal obligations regarding User Data;
- violates any applicable law for accessing or using the Siemens Website;
- has not used the Siemens Website for a long time.
The User provides accurate information for registration and updates this information without delay if it changes over time (as far as possible: online). The User guarantees that the e-mail address provided to Siemens is continuously used and that Siemens can communicate with the User via this address.
Upon registration, the User is provided with an access code containing a User Name and password ("User Data"). When the User first logs into the site, they change the password received from Siemens to a password known only to themselves. The User can view and change User Data, or, in applicable cases, revoke data processing consent, using the User name and password.
The User guarantees that User Data is not accessible to third parties and is responsible for all transactions and other activities carried out with User Data. At the end of each online session, the User logs out of the password-protected websites. If the User notices that User Data has been misused by third parties, they will immediately inform Siemens in writing or, depending on the situation, by e-mail.
Following the warning in Article 3.4, Siemens will stop access to the password-protected area with the User Data in question. The User's re-access to the site will only be possible after the User applies to Siemens or opens a new registration.
Unless the cancellation infringes the proper performance of the contractual relationship, the User may request in writing the termination of their registration at any time. In this case, Siemens will immediately delete all user data and the User's stored personal data when this data is no longer needed.
4. Right to Use Information, Software, and Documentation
The use of any information, software, and documentation provided within or through this Siemens Website is subject to these Terms of Use, or, in the event of an update to the information, software, or documentation, to the applicable license terms previously agreed upon with Siemens. Separately agreed license terms, such as for software downloads, supersede these Terms of Use.
Siemens grants the User a non-exclusive, non-transferable, and non-sublicensable license to use the information, software, and documentation provided within or through the Siemens Website to the extent agreed upon, or, if no such agreement exists, in line with Siemens' intention to provide this information, software, and documentation.
Software is provided in object code without any charge. There is no right to receive the source code. This will not apply to source codes related to open-source software where license terms supersede these Terms of Use and where the provision of source code is required. In such cases, Siemens will provide the source code for a fee.
Information, software, and documentation may not be distributed, leased, or otherwise made available to any third party by the User in any way. Unless mandatory laws permit, the User will not modify the software or documentation, nor will they disassemble, reverse engineer, decompile, or separate any part of the software. The User may make a single backup copy of the software if necessary for later use in accordance with the Terms of Use.
Information, software, and documentation are protected by copyright laws, as well as international copyright treaties and other intellectual property laws and agreements. The User will observe these laws and, in particular, will not alter, conceal, or delete any alphanumeric codes, marks, or copyright notices in the information, software, or documentation or their copies.
5. Intellectual Property
Notwithstanding the provisions of Article 4 of these Terms of Use, information, brand names, and other content on the Siemens Website may not be modified, copied, reproduced, sold, leased, used, expanded with additions, or otherwise exploited without Siemens' prior written consent.
Except for the rights of use and other rights explicitly granted herein, no rights are granted to the User, and no obligation to grant further rights is implied. All patent rights and licenses are expressly excluded.
Siemens may use any idea or suggestion stored on the Siemens Website by a User for the development, improvement, and sale of its products without any compensation.
6. User's Responsibilities
When the User visits or uses the Siemens Website, they shall:
- not harm anyone, especially minors, or violate anyone's personal rights;
- not act contrary to public morals in their use of the site;
- not infringe any intellectual property rights or other proprietary rights;
- not upload any content containing viruses, also known as Trojan horses, or any other program that could damage data;
- not transmit, store, or upload hyperlinks or content for which the User is not authorized (especially if such hyperlinks or content violate confidentiality obligations or are illegal);
- not send advertisements or unsolicited e-mails ("spam") or false warnings of viruses, malfunctions, or similar material, and the User will not insist on or request any lottery, snowball system (pyramid scheme), chain letters, pyramid scheme, or similar activities.
Siemens may block access to the Siemens Website at any time, especially if the User violates any obligation arising from these Terms of Use.
7. Hyperlinks
The Siemens Website may contain hyperlinks to third-party websites. Siemens does not assume responsibility for the content of such websites and does not adopt or endorse the content and information presented on them, as Siemens does not control the information on these web pages and is not responsible for them. The risks arising from the use of such web pages are solely borne by the User.
8. Liability for Intellectual and Industrial Property or Quality Defects
Siemens' liability for quality and intellectual and industrial property defects will be determined in accordance with the provisions of Article 8 of these Terms of Use. Siemens has no other liability except in cases mandated by law (e.g., in cases of intent, gross negligence, physical injury or death, non-provision of guaranteed features, deliberate concealment of a defect, or breach of fundamental contractual obligations). In case of breach of fundamental contractual obligations, damages are limited to the scope of the contract and only to direct damages, unless there is intent or gross negligence.
Information on the Siemens Website may, in some cases (e.g., due to product changes), contain technical information or general descriptions regarding the technical capacity of products that may not be currently available. In such cases, the requested performance of the product will be subject to mutual agreement for each specific situation at the time of purchase.
9. Other Responsibilities, Cyber Attacks, and Malware
While Siemens makes every effort to protect the Siemens Website from cyber attacks and malware, it cannot guarantee that it is completely free of malware. The User will take necessary steps to implement appropriate security measures to protect themselves and will use a virus scanner before downloading any information, software, or documents.
Articles 9.1 and 9.2 do not imply or constitute any change in the burden of proof brought against the User.
10. Compliance with Export Control Regulations
If the User transfers information, software, and documentation provided by Siemens to a third party, they will comply with all applicable national and international (re-)export control regulations. In such a transfer, the User will comply with the (re-)export control regulations in the Federal Republic of Germany, the European Union, and the United States of America.
Before such a transfer to a third party, the User will especially perform the necessary checks and provide guarantees regarding the following:
- No embargo imposed by the European Union, the United States of America, and/or the United Nations will be violated as a result of such a transfer or by providing other economic resources related to the information, software, or documentation provided by Siemens; during this process, limitations applicable to local businesses and prohibitions on circumventing these embargoes by different means will also be considered;
- Such information, software, and documentation provided by Siemens will not be used in connection with ammunition, nuclear technology, or weapons unless necessary authorization is obtained if subject to any prohibition or authorization;
- All applicable Sanctioned Parties List regulations of the European Union and the United States of America regarding trade with sanctioned legal entities, natural persons, and organizations will be taken into account.
For authorities or Siemens to conduct export control audits when necessary, the User will immediately provide Siemens, upon Siemens' request, with all information regarding the end-user, destination, and intended use of the information, software, and documentation provided by Siemens, and all existing export control restrictions.
The User shall indemnify and hold Siemens harmless from any claims, prosecutions, lawsuits, fines, losses, costs, and damages arising from or related to the User's non-compliance with export control regulations. The User will also compensate Siemens for all such losses and resulting expenses, except for non-compliances not caused by the User's fault. This provision does not imply any change in the burden of proof.
Siemens' obligation to fulfill the requirements of a contract is subject to the condition that the fulfillment of said requirements is not hindered by any impediment arising from national and international foreign trade and customs requirements or from embargoes or other sanctions.
11. Protection of Data Privacy
In the collection, use, and processing of the personal data of the Siemens Website User, Siemens will comply with both the applicable data protection laws and the Siemens Website Personal Data Protection and Processing Policy provided via the Siemens Website and/or the hyperlink at www.siemens.com.tr.
12. Additional Agreements, Authorized Courts, Applicable Laws
Any additional agreement must be in writing.
Istanbul (Anatolian) courts will have jurisdiction in disputes arising from the contract.
Every page of the Siemens Website is operated and managed by Siemens Aktiengesellschaft and/or its affiliates. These pages comply with the laws applicable in the country where the responsible company is commercially registered. Siemens makes no representation that the information, software, and/or documentation on the Siemens Website is appropriate or available for viewing or downloading outside the said country. If Users access the Siemens Website from outside the said country, they will be responsible for compliance with applicable local laws. Access to information, software, and/or documentation on the Siemens Website from countries where the content is illegal is prohibited. In this case, and if the User wishes to do business with Siemens, the User should contact the Siemens representative in the specific country to conduct country-specific business.
These Terms of Use are subject to Turkish laws, excluding conflict of laws, and all disputes related to or connected with these Terms of Use or their subject matter will be resolved in accordance with Turkish laws (excluding conflict of laws). The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) dated April 11, 1980, is excluded.
