Why are our e-invoices valid without an electronic signature?
We often receive feedback that our e-invoices do not comply with regulations because they do not have an electronic signature.
This statement is incorrect for the following reasons:
In accordance with the applicable legislation on electronic invoicing and the information published on the website of the National Tax and Customs Administration on April 16, 2020, entitled "The most important things to know about electronic invoices" - https://nav.gov.hu/nav/ado/afa/Az_elektronikus_szaml20200416.html - (hereinafter referred to as the NAV information sheet), we hereby declare the following with regard to the signing of electronic invoices issued by our company:
Act CXXVII of 2007 on Value Added Tax (hereinafter: VAT Act) specifies two procedures in which it is accepted by law that electronic invoices meet the requirements for authenticity of origin and integrity of data content.
At the same time, the above-mentioned NAV information states that "since the list in the VAT Act is not exhaustive, solutions that differ from those listed but ensure the authenticity of the origin and the integrity of the data content may also be appropriate."
The information notice mentions, by way of example, the issuance of invoices using a business control procedure and an integrated enterprise management system that ensures the authenticity of the origin of the invoice and the integrity of its data content.
According to the NAV information sheet, invoices issued using such a corporate management system do not need to bear an electronic signature, as invoices issued in a closed system meet the requirements for authenticity and integrity without an electronic signature.
As our company's invoices are issued in an audited system using a closed administrative procedure, they comply with the applicable legislation even without an electronic signature.
