Kennisgeving inzake data privacy bij Siemens

De bescherming van de veiligheid en privacy van uw persoonsgegevens is voor Siemens van groot belang. Daarom verwerkt Siemens (zie voor meer informatie over de onderneming onderstaande “Bedrijfsinformatie”) persoonsgegevens conform de toepasselijke wetgeving betreffende data privacy en data security.
 

Categorieën van verwerkte persoonsgegevens, doel van de verwerking en rechtsgrond 

Als u gebruik maakt van websites, applicaties of online tools van Siemens (hierna aangeduid als het "Siemens online serviceaanbod") verwerkt Siemens mogelijk de volgende u betreffende persoonsgegevens:

  • Persoonsgegevens die u actief en vrijwillig verstrekt via het Siemens online serviceaanbod (bijv. bij registratie, als u contact met ons opneemt met een vraag, of bij deelname aan een enquête, enz.), waaronder naam, e-mailadres, telefoonnummer, informatie verstrekt in het kader van een verzoek om ondersteuning, het plaatsen van opmerkingen of berichten op een forum, enz.; en 
  • Informatie die automatisch naar ons wordt verzonden door uw webbrowser of apparaat, zoals uw IP-adres, type apparaat, type browser, doorverwijzende site, door u bezochte sites, en de datum en het tijdstip van een afzonderlijk verzoek van een bezoeker. 

Wij verwerken uw persoonsgegevens voor de volgende doeleinden: 

  • Voor het verstrekken van diensten en functies van het Siemens online serviceaanbod en het beheren van uw gebruik van het Siemens online serviceaanbod. 
  • Voor het verifiëren van uw identiteit (als u geregistreerd bent bij het Siemens online serviceaanbod);
  • Voor het beantwoorden en afhandelen van uw specifieke verzoeken; en
  • Voor zover redelijkerwijs noodzakelijk, voor het handhaven van de toepasselijke gebruiksvoorwaarden, het vaststellen of instandhouden van een juridische vordering of verdediging, ter voorkoming van fraude of andere wederrechtelijke activiteiten, waaronder aanvallen op de IT-systemen van Siemens. 

De verwerking van uw persoonsgegevens is noodzakelijk om bovenstaande doelstellingen te verwezenlijken.  Tenzij u anders heeft aangegeven op het moment dat de gegevens werden verzameld, is de rechtsgrond voor de verwerking van de persoonsgegevens gelegen in het feit dat: 

  • U uitdrukkelijk toestemming hebt gegeven voor de verwerking van uw persoonsgegevens (Artikel 6, lid 1a van de Algemene Verordening Gegevensbescherming);
  • De verwerking noodzakelijk is voor de uitvoering van een overeenkomst met u (Artikel 6, lid 1b van de Algemene Verordening Gegevensbescherming); of
  • De verwerking overigens noodzakelijk is voor de efficiënte uitvoering of het beheer van uw gebruik van het Siemens online serviceaanbod (Artikel 6, lid 1f van de Algemene Verordening Gegevensbescherming);

Wij zijn gerechtigd tot het gebruik van cookies binnen het Siemens online serviceaanbod. In ons Cookiebeleid vindt u informatie over het gebruik van cookies door Siemens. Dit Privacybeleid is alleen van toepassing op het Siemens online serviceaanbod en niet op andere websites of applicaties die door derden worden geëxploiteerd. Categorieën van verwerkte persoonsgegevens, doel van de verwerking en rechtsgrond

In het kader van de zakelijke relatie met Siemens mag Siemens de volgende categorieën persoonsgegevens van huidige en toekomstige contactpersonen bij uw klanten, leveranciers, verkopers en partners (hierna elk afzonderlijk aangeduid als "zakenrelatie") verwerken:  

  • Contactgegevens, zoals voor- en achternaam, werkadres, zakelijk telefoonnummer, zakelijk mobiel telefoonnummer, zakelijk faxnummer en zakelijk e-mailadres; 
  • Betalingsgegevens, zoals gegevens die noodzakelijk zijn voor het verwerken van betalingen en het voorkomen van fraude, waaronder creditcard- en bankpasnummers, veiligheidscodes en overige verwante factureringsgegevens; 
  • Overige informatie die noodzakelijkerwijs wordt verwerkt in een project of in het kader van een overeenkomst met Siemens of vrijwillig wordt verstrekt door de zakenrelatie, zoals persoonsgegevens die verband houden met geplaatste bestellingen, uitgevoerde betalingen, verzoeken en projectmijlpalen; 
  • Persoonsgegevens afkomstig van openbaar beschikbare bronnen, databanken omtrent persoonlijke integriteit en kredietregistratiebureaus; en
  • Indien wettelijk vereist voor de controle of een zakenrelatie voldoet aan de wettelijke eisen: geboortedatum, ID-nummers, identiteitspassen en informatie over relevante en belangrijke rechtszaken of andere juridische procedures waar een zakenrelatie in verwikkeld is.

Siemens kan de persoonsgegevens voor de volgende doeleinden verwerken: 

  • Communiceren met zakenrelaties over producten, diensten en projecten van Siemens of zakenrelaties, bijv. door te reageren op vragen of verzoeken of door technische informatie over afgenomen producten aan u te verstrekken;
  • Plannen, uitvoeren en beheren van de relatie (op grond van een overeenkomst) met Handelpartners, bijv. door tenuitvoerlegging van transacties en bestellingen van producten en diensten, verwerking van betalingen, uitvoering van activiteiten in het kader van de boekhouding, financiële controle, facturering en betalingsontvangst, regelen van verzendingen en leveringen, mogelijk maken van reparaties en leveren van ondersteunende diensten;
  • Beheer en uitvoering van klantenonderzoeken, marketingcampagnes, marktanalyses, loterijen, wedstrijden en andere promotieactiviteiten of -evenementen;
  • Handhaven en beschermen van de veiligheid van onze producten, diensten en websites, voorkomen en opsporen van veiligheidsbedreigingen, fraude of andere criminele of kwaadwillende activiteiten; 
  • Zorgen voor naleving van wettelijke verplichtingen (zoals archiveringsplicht), exportcontrole en douaneverplichtingen, verplichtingen betreffende de controle of een zakenrelatie voldoet aan wettelijke eisen (ter voorkoming van witteboordencriminaliteit of witwaspraktijken), en Siemens-beleidsprocedures of in de bedrijfstak geldende standaarden. 
  • Het beslechten van geschillen, het ten uitvoer leggen van onze contractuele afspraken en voor de vaststelling, uitoefening of verdediging van een recht in rechte.

De verwerking van persoonsgegevens is noodzakelijk om bovenstaande doelen te verwezenlijken. Tenzij u anders heeft aangegeven op het moment dat de gegevens werden verzameld, is de rechtsgrond voor de verwerking van de persoonsgegevens gelegen in het feit dat:

  • U uitdrukkelijk toestemming hebt gegeven voor de verwerking van uw persoonsgegevens (Artikel 6, lid 1a van de Algemene Verordening Gegevensbescherming);
  • De verwerking noodzakelijk is voor de uitvoering van de overeenkomst met u (Artikel 6, lid 1b van de Algemene Verordening Gegevensbescherming); of
  • De verwerking overigens noodzakelijk is voor de efficiënte uitvoering of het beheer van onze zakelijke relatie met u (Artikel 6, lid 1f van de Algemene Verordening Gegevensbescherming);

Siemens kan persoonsgegevens doorgeven aan andere Siemens-ondernemingen of aan derden, maar uitsluitend indien en voor zover als een dergelijke doorgifte vereist is voor de bovengenoemde doeleinden.

Indien wettelijk toegestaan, kan Siemens persoonsgegevens verstrekken aan rechtbanken, wetshandhavingsinstanties, toezichthouders of advocaten, indien dit noodzakelijk is voor naleving van wetgeving of voor de vaststelling, uitoefening of verdediging van een recht in rechte. 

Siemens maakt gebruik van dienstverleners (zogenoemde gegevensverwerkers), zoals hosting- of IT-onderhouddienstverleners, die uitsluitend handelen in opdracht van Siemens en contractueel verplicht zijn te handelen conform de toepasselijke wetgeving inzake gegevensbescherming.

Ontvangers van persoonsgegevens bevinden zich mogelijk in landen buiten de Europese Economische Ruimte ("derde landen"), waar de wetgeving niet hetzelfde niveau van gegevensbescherming waarborgt als in het land van de betreffende persoon. 

In dergelijke gevallen neemt Siemens maatregelen om op andere wijze passende en geschikte waarborgen in te bouwen ter bescherming van persoonsgegevens. 

  • We delen persoonsgegevens uitsluitend met Siemens-ondernemingen in derde landen, als zij de bindende bedrijfsvoorschriften van Siemens ("Siemens Binding Corporate Rules" / "BCR") ter bescherming van persoonsgegevens hebben geïmplementeerd. Meer informatie over de Siemens BCR vindt u hier.
  • We geven uw gegevens uitsluitend door aan externe ontvangers in derde landen indien de desbetreffende ontvanger (i) de EU-standaardcontractbepalingen met Siemens is aangegaan, (ii) de Binding Corporate Rules in zijn organisatie heeft geïmplementeerd, of (iii) – in het geval van ontvangers in de VS – de ontvanger gecertificeerd is op grond van het Privacy Shield. Betrokkenen mogen verzoeken om nadere informatie en om kopieën van de waarborgen; hiertoe kunnen zij contact opnemen met Siemens. 

Persoonsgegevens die door u worden gepubliceerd binnen het Siemens online serviceaanbod (bijv. in chat rooms of op forums) zijn mogelijke wereldwijd toegankelijk voor andere geregistreerde gebruikers van het desbetreffende Siemens online serviceaanbod.  

Tenzij uitdrukkelijk anders aangegeven op het moment dat de persoonsgegevens zijn verzameld (bijv. door middel van een door u bevestigd toestemmingsformulier) wissen wij persoonsgegevens, indien bewaring van de persoonsgegevens niet langer noodzakelijk is voor de doeleinden waarvoor zij zijn verzameld of anderszins zijn verwerkt, en wij niet meer wettelijk verplicht zijn tot verdere bewaring van persoonsgegevens (bijv. op grond van belasting- of handelswetgeving).

In het geval u toestemming hebt gegeven voor de verwerking van bepaalde persoonsgegevens door Siemens, mag u op elk moment deze toestemming met toekomstige werking intrekken, dat wil zeggen als u uw toestemming intrekt, laat dit de rechtmatigheid van de verwerking op basis van de eerder gegeven toestemming onverlet. In het geval de toestemming is ingetrokken, mag Siemens de persoonsgegevens uitsluitend verder verwerken, indien er een andere rechtsgrond voor verwerking is. 

Op grond van de toepasselijke wetgeving inzake gegevensbescherming heeft u - mits aan de betreffende wettelijke voorwaarden is voldaan - mogelijk recht om:

  • Van Siemens bevestiging te verkrijgen of uw persoonsgegevens worden verwerkt, en zo ja, toegang tot deze persoonsgegevens te verkrijgen;
  • Van Siemens rectificatie van u betreffende onjuiste persoonsgegevens te verkrijgen;
  • Van Siemens wissing van uw persoonsgegevens te verkrijgen; 
  • Van Siemens beperking van de verwerking van u betreffende persoonsgegevens te verkrijgen; 
  • Te verlangen dat de persoonsgegevens die u actief hebt verstrekt in een overdraagbaar formaat zijn opgesteld; en
  • Bezwaar te maken, vanwege met uw specifieke situatie verband houdende redenen, tegen de verwerking van u betreffende persoonsgegevens.

De Siemens-organisatie inzake data privacy biedt ondersteuning betreffende alle vragen, opmerkingen, aandachtspunten of klachten die verband houden met bescherming van persoonsgegevens, of in het geval u bepaalde rechten betreffende de bescherming van uw persoonsgegevens wilt uitoefenen. Xaxis
We permit the company Xaxis (a division of GroupM Competence Center GmbH, Derendorfer Allee 10, 40476 Düsseldorf), to place cookies on our websites that collect information on usage-based online advertising; this is also known as “targeting.”

    3.6. The User may at any time request termination of its registration in writing, provided that the deletion will not violate the proper performance of contractual relationships. In such event Siemens will remove all user data and other stored personally identifiable data of the User as soon as these data are no longer needed.

    4.1. The use of any information, software and documentation made available on or via this Siemens Web Site is subject to these Terms of Use or, in case of updating information, software or documentation, subject to the applicable license terms previously agreed to with Siemens. Separately agreed to license terms, for example software downloads, shall prevail over these Terms of Use.

    4.2. Siemens grants User a non-exclusive and non-transferable license, which may not be sublicensed, to use the information, software and documentation made available to the User on or via the Siemens Web Site to the extent agreed, or in the event of no such agreement to the extent of the purpose intended by Siemens in making same available.

    4.3. Software shall be made available at no expense in object code. There shall be no right for the source code to be made available. In such case Siemens shall make the source code available in return for the payment of costs.

    4.4. Information, software and documentation may not be distributed by the User to any third party at any time nor may it be rented or in any other way made available. Unless such is allowed by mandatory law, the User shall not modify the software or documentation nor shall it disassemble, reverse engineer or decompile the software or separate any part thereof. The User may make one backup copy of the software where necessary to secure further use in accordance with these Terms of Use.

    4.5. The information, software and documentation are protected by copyright laws as well as international copyright treaties as well as other laws and conventions related to intellectual property.     6.2. Siemens may deny access to the Siemens Web Site at any time, in particular if the User breaches any obligation arising from these Terms of Use.

The Siemens Web Site may contain hyperlinks to the web pages of third parties. Siemens shall have no liability for the contents of such web pages and does not make representations about or endorse such web pages or their contents as its own, as Siemens does not control the information on such web pages and is not responsible for the contents and information given thereon. The use of such web pages shall be at the sole risk of the User.

    8.1. Insofar as any information, software or documentation is made available at no cost, any liability for defects as to quality or title of the information, software and documentation especially in relation to the correctness or absence of defects or the absence of claims or third party rights or in relation to completeness and/or fitness for purpose are excluded except for cases involving willful misconduct or fraud.

    8.2. The information on the Siemens Web Site may contain specifications or general descriptions related to the technical possibilities of individual products which may not be available in certain cases (e.g. due to product changes). The required performance of the product shall therefore be mutually agreed in each case at the time of purchase.

    9.1. The liability of Siemens for defects in relation to quality and title shall be determined in accordance with the provisions of § 8 of these Terms of Use. Any further liability of Siemens is excluded unless required by law, e.g. under the Act on Product Liability or in cases of willful misconduct, gross negligence, personal injury or death, failure to meet guaranteed characteristics, fraudulent concealment of a defect or in case of breach of fundamental contractual obligations. The damages in case of breach of fundamental contractual obligations is limited to the contract-typical, foreseeable damage if there is no willful misconduct or gross negligence.

    9.2. Although Siemens makes every endeavor to keep the Siemens Web Site free from viruses, Siemens cannot make any guarantee that it is virus-free. The User shall, for its own protection, take the necessary steps to ensure appropriate security measures and shall utilize a virus scanner before downloading any information, software or documentation.

    9.3. §§ 9.1 and 9.2 do not intend nor imply any changes to the burden of proof to the User's disadvantage.

    10.1. If the User transfers information, software and documentation provided by Siemens to a third party, the User shall comply with all applicable national and international (re-) export control regulations. In any event of such transfer the User shall comply with the (re-) export control regulations of the Federal Republic of Germany, of the European Union and of the United States of America.

    10.2. Prior to any such transfer to a third party the User shall in particular check and guarantee by appropriate measures that
    - There will be no infringement of an embargo imposed by the European Union, by the United States of America and/ or by the United Nations by such transfer or by provision of other economic resources in connection with information, software and documentation provided by Siemens, also considering the limitations of domestic business and prohibitions of by-passing those embargos;
    - Such information, software and documentation provided by Siemens are not intended for use in connection with armaments, nuclear technology or weapons, if and to the extent such use is subject to prohibition or authorization, unless required authorization is provided;
    - The regulations of all applicable Sanctioned Party Lists of the European Union and the United States of America concerning the trading with entities, persons and organizations listed therein are considered.

    10.3. If required to enable authorities or Siemens to conduct export control checks, the User, upon request by Siemens, shall promptly provide Siemens with all information pertaining to the particular end-user, the particular destination and the particular intended use of information, software and documentation provided by Siemens, as well as any export control restrictions existing.

    10.4. The User shall indemnify and hold harmless Siemens from and against any claim, proceeding, action, fine, loss, cost and damages arising out of or relating to any noncompliance with export control regulations by the User, and the User shall compensate Siemens for all losses and expenses resulting thereof, unless such noncompliance was not caused by fault of the User. This provision does not imply a change in burden of proof.

    10.5. Siemens' obligation to fulfill an agreement is subject to the proviso that the fulfillment is not prevented by any impediments arising out of national and international foreign trade and customs requirements or any embargos or other sanctions.

For collection, use and processing of personally identifiable data of the User of the Siemens Web Site, Siemens shall comply with applicable laws on data privacy protection and the Siemens Web Site Data Protection Privacy Notice, which is available per hyperlink on the Siemens Web Site and/or on www.siemens.com.

    12.1. Any supplementary agreement requires the written form.

    12.2. The place of jurisdiction shall be Munich if the User is a merchant in terms of the German Commercial Code (Handelsgesetzbuch).

    12.3. The individual pages of the Siemens Web Site are operated and administered by Siemens Aktiengesellschaft and/or its affiliates. The pages comply with the law applicable in the country where the responsible company has its business residence. Siemens makes no representation that information, software and/or documentation on the Siemens Web Site are appropriate or available for viewing or downloading at locations outside such country. If Users access Siemens Web Site from outside such country, they are exclusively responsible for compliance with all applicable local laws. Access to Siemens Web Site's information, software and/or documentation from countries where such content is unlawful is prohibited. In this case and where User seeks to do business with Siemens, the User should contact the Siemens representative for the particular country for country specific business.

    12.4. These Terms of Use shall be governed by - and all disputes relating to or in connection with these Terms of Use or their subject matter shall be resolved in accordance with - the laws of Germany, to the exclusion of its conflict of laws rules. The application of the United Nations Convention on Contracts for the International Sales of Goods (CISG) of 11 April 1980 is excluded.

Siemens issues digital certificates ("Certificates", also known as "Digital IDs") to its employees and agents, to its known business partners and to Siemens web sites in accordance with its „Siemens Issuing CA“.

OCSP Responder

A special OCSP Responder is operated to provide an interface for a qualified validity check of certificates within the Siemens PKI. The OCSP responder return a signed response signifying that the certificate specified in the request is good, revoked, unknown or unauthorized. If it cannot process the request, it returns an error code. Requests for certificate which are not provided by one of the Siemens CA’s will by rejected as “unknown”.

Public Certificate Repository
Siemens operates a publicly accessible Certificate Repository. In the Certificate Repository the Certificates of the Siemens PKI are stored. The Certificate Repository is available on the Internet to enable the exchange of secure e-mails with Siemens.
The Certificate Repository offers an Online Search for Siemens certificates. To retrieve Certificates directly from the Certificate Repository, it must be set up and configured as LDAP directory in the respective e-mail encryption program.

The Certificate Repository also contains the Siemens PGP certificates. It can be used with all PGP clients supporting LDAP.

European Bridge CA
Siemens is a member of the European Bridge CA.

The European Bridge CA operates a virtual Directory Service. Certificates of participants from different companies can be called up via this Directory Service. For this the LDAP-queries of the Bridge-CA are forwarded to the repositories of the connected organizations. Also the Siemens PKI Certificate Repository can be called up via this service.
The European Bridge CA offers an online search for certificates. Here also all Siemens certificates can be found if the correct mail-address is provided.
To use the Bridge-CA Repository it must be set up and configured as an LDAP directory the respective e-mail encryption program:
